In plain wordsThis agreement covers making offers and buying a vehicle on JDM Rush. It works together with the Terms of Service.
This Buyer Agreement applies when you negotiate for or purchase a vehicle on the JDM Rush Marketplace and supplements the Terms of Service, which remain in effect. By accepting this agreement and making an offer you confirm that you have read and agree to it. If this agreement conflicts with the Terms of Service on a buying-specific matter, this agreement governs.
In plain wordsOnly offer what you're prepared to pay. If your offer is accepted — including automatically — you're expected to sign and complete the deal. Offers expire after 72 hours.
An offer you submit through the Platform is a genuine expression of intent to purchase at that price. You acknowledge that the seller may have configured automatic acceptance, so an offer at or above the seller's threshold may be accepted instantly and generate a contract without further human review. When your offer is accepted, or you accept a seller's counter-offer, you agree to review and electronically sign the generated bill of sale within the period shown on the Platform, and to complete the purchase in accordance with it. Offers expire automatically if unanswered after the period shown on the Platform (currently 72 hours). You may withdraw an offer through the Platform at any time before it is accepted. Repeatedly making offers and failing to honour acceptances may result in suspension of your account.
In plain wordsRush represents the seller, not you. It's AI software applying the seller's price rules. The listing — not the chat — is the official description of the car.
Negotiation on the Platform is conducted with Rush, an automated assistant acting on behalf of the seller and applying pricing parameters the seller has set. Rush does not represent you, does not owe you advice, and its conversational messages are generated by artificial-intelligence language models and may contain errors. The authoritative description of the vehicle is the listing itself, including its condition disclosures and known issues, together with the bill of sale; statements made in chat do not modify the listing or the contract. Chat transcripts are retained and processed as described in the Privacy Policy. Do not share sensitive personal or financial information in chat; it is never required.
In plain wordsYou won't see the seller's identity (or they yours) until the contract is signed by both parties and the seller's platform fee is paid. You pay JDM Rush nothing.
Buyer and seller identities are withheld from each other during negotiation. After both parties sign the bill of sale and the seller pays the platform fee, each party's legal name and contact details are released to the other to complete the sale. Buyers pay no fee to JDM Rush. You agree not to attempt to identify or contact the seller outside the Platform before identity release and not to use the Platform to harvest information about sellers or their vehicles for purposes unrelated to a genuine purchase.
In plain wordsThis is a private sale of a used, imported vehicle, as-is. Checking the car, its history, liens, and what your province requires to register it is your job — do it before you offer, or make the deal conditional in writing with the seller after reveal.
Vehicles on the Platform are sold by private sellers on an as-is basis, as described in the listing and the bill of sale, without any warranty, condition, or guarantee from JDM Rush, express or implied. JDM Rush does not inspect vehicles, verify listings, or confirm VINs, odometers, liens, or import status. Before making an offer you are responsible for your own due diligence, and after identity release and before completing payment you are responsible for verifying the vehicle, including, as you consider appropriate: physical or third-party inspection, a lien search in the relevant provincial registry, VIN and history verification, and confirmation of the requirements your province or territory imposes to register, insure, and (where applicable) safety-certify an imported right-hand-drive or grey-market vehicle. Many JDM vehicles have characteristics — age, right-hand drive, imported odometer units, modification history — that affect registration, insurance availability, and cost in some provinces; confirming these for your situation is your responsibility.
In plain wordsYou sign electronically. After identities are revealed, you pay the seller directly and complete the paperwork with them — the platform doesn't hold your money.
The bill of sale generated by the Platform is a contract between you and the seller; JDM Rush is not a party to it. Electronic signatures applied through the Platform (typed or drawn) are binding, and you consent to transacting and receiving records electronically. After identity release, you and the seller complete the transaction directly: payment of the purchase price passes directly from you to the seller and never through JDM Rush — we are not an escrow service, we do not hold or guarantee funds, and we will never ask you to send the purchase price to us or to an account we designate. Exercise ordinary caution in choosing a payment method with the seller. Taxes, registration, transfer fees, insurance, and any inspection your province requires are your responsibility as buyer.
In plain wordsUnsigned contracts expire and free both sides. Problems after the sale are between you and the seller.
If a generated contract is not signed by both parties within the period shown on the Platform, it expires, both parties are released from it, and the vehicle may be relisted. If a signed deal fails to complete, or a dispute arises about the vehicle after completion, the dispute is between you and the seller; the Terms of Service govern JDM Rush's role and the limits of its liability. We may, in our discretion, review conduct on the Platform in connection with a failed deal and take account-level action, but we do not adjudicate private disputes or provide refunds of the purchase price, which we never held.
In plain wordsGenuine offers only, no fee-dodging with sellers, no misusing Rush. Ontario law governs, as in the Terms of Service.
You agree not to (a) make offers without genuine intent to purchase; (b) arrange with a seller to complete a Platform-negotiated deal off-Platform to help avoid the platform fee; (c) misuse, probe, or manipulate Rush or other automated systems; or (d) use the Platform to collect information about sellers or vehicles for purposes unrelated to a genuine purchase. Breach may result in cancelled negotiations and account termination. This agreement is governed by the same law and dispute-resolution terms as the Terms of Service, and the Terms of Service's disclaimers, limitations of liability, and indemnity apply to it.
